Rideshare Driver Injured by Another Driver: Can I Use Uber or Lyft UM/UIM Coverage?

Quick Answer

Yes, if you were in Period 2 or Period 3 when the crash happened. Uber and Lyft maintain uninsured and underinsured motorist coverage during active trips, which protects drivers hit by motorists with no insurance or too little. The gap is Period 1: app on, waiting for a request, where that platform UM and UIM protection generally does not apply and your own policy carries the load.

Rideshare drivers spend their shifts surrounded by other people's driving. When another motorist causes the crash and carries state minimum limits or no insurance at all, the question becomes whose uninsured and underinsured motorist coverage steps up. The answer depends, as everything in rideshare insurance does, on your app status at the moment of impact.

Periods 2 and 3: the platform's UM and UIM protects you

While you are en route to a pickup or carrying a passenger, Uber and Lyft maintain uninsured and underinsured motorist coverage as part of the commercial policy stack that Nevada requires under NRS 690B.470. If an uninsured driver runs a light on Tropicana and totals your car mid trip, that platform UM coverage is a primary recovery source for your injuries, on top of whatever the at fault driver's policy pays, if anything.

Claiming it requires proving the period, which means your own app records matter: screenshot your trip screen after any crash, before anything refreshes or logs out. The platform's telemetry will confirm it later, but your screenshot settles the argument on day one.

Period 1: the gap that catches drivers

App on, no ride accepted, waiting: this is where drivers are most exposed. The platforms' contingent liability coverage in Period 1 protects people you might hit, not you. Platform UM and UIM protection generally does not extend to Period 1, so a driver rear ended by an uninsured motorist while waiting for a request is usually looking at their own policy. And here is the trap: many personal auto policies exclude coverage while any rideshare app is on, treating the whole shift as commercial use. Without a rideshare endorsement, a Period 1 driver can be functionally uninsured for their own injuries.

The rideshare endorsement is the fix

Several insurers sell rideshare endorsements in Nevada that extend a personal policy across Period 1, closing the gap between personal coverage and the platforms' commercial coverage. Drivers who work the apps regularly should carry one, along with meaningful UM and UIM limits on their own policy, because your own UM and UIM coverage follows you and can apply on top of the platform's in serious cases. The premium difference is small compared to one uncovered emergency room visit.

What to do after a crash on shift

Screenshot your app status immediately. Get medical care the same day. Report the crash in the app so the platform record exists. Get the other driver's information and the police report, which is what establishes their uninsured status. Then have an attorney tender the claim to the correct stack of carriers: the at fault driver's insurer, the platform's UM and UIM carrier if you were in Period 2 or 3, and your own policy where it applies. The platform specific claim mechanics are on our Uber accident page and Lyft accident page, and the full coverage framework is on the rideshare overview.

Frequently Asked Questions

Does workers' compensation cover rideshare drivers in Nevada?

Uber and Lyft classify drivers as independent contractors, so traditional workers' compensation generally does not apply. The platforms have at times offered separate injury protection products for drivers, and any such coverage is worth checking, but the core recovery sources after a crash caused by another motorist are the coverage stack described above.

The at fault driver had minimum limits and my injuries are serious. What order do the coverages pay?

Typically the at fault driver's liability limits pay first, then underinsured motorist coverage responds to the shortfall: the platform's UIM if you were in Period 2 or 3, and your own UIM per its terms. Coordination between carriers is where these claims get technical, and where counsel earns their fee.

Will Uber or Lyft deactivate me for making a claim?

Reporting a crash is required by the platforms' own rules, and claiming coverage you are entitled to is not misconduct. Deactivation decisions follow their safety policies about the crash itself, not the insurance claim.

I drive for both apps. Which platform's coverage applies?

The one whose app you were active on in the relevant period at the moment of the crash. Driving with both apps on in Period 1 complicates the analysis, which makes your own screenshots and the platforms' records more important, not less.
